Our office successfully helped a client obtain I-130 & I-485 approvals in less than 3 months, even with prior visa overstay, unlawful employment, and unlawful presence issues, based on marriage to a U.S. citizen.

The marriage-based adjustment package was carefully prepared and strategically filed, and the interview was scheduled about 2 months after submission. From filing to I-485 approval, the entire process was completed in only about 3 months, and the case was approved without any Request for Evidence (RFE).

From the outset, our office focused on preparing a complete and well-organized filing package to minimize delays and avoid additional document requests. We also conducted a thorough mock interview with the couple so they could be fully prepared for the types of questions that may arise during the green card interview.

After the interview, USCIS issued a notice stating that the case required additional review. This is very common these days for marriage-based green card interviews. Even when the interview goes smoothly and no additional documents are requested, it is now quite rare for USCIS to approve the case on the spot.

Rather than waiting 60 or 90 days to follow up per the instructions on the notice, our office acted promptly and made an inquiry within one week. On the same day as our first follow-up, USCIS approved the I-130 petition. The I-485 remained pending a little longer, so we followed up again, and on the day of our second inquiry USCIS approved the I-485.
