The EB-1A visa is designed for individuals who possess extraordinary ability in fields such as science, arts, education, business, or athletics. This visa allows individuals to self-petition, meaning no job offer or employer sponsorship is required.

To qualify, applicants must provide evidence of a one-time achievement (such as a Pulitzer, Oscar, or Olympic Medal) or meet at least 3 out of the following 10 criteria:

* Lesser nationally or internationally recognized prizes or awards for excellence.

* Membership in associations in the field that demand outstanding achievement.

* Published material about you in professional or major trade publications or other major media.

* Judging the work of others, either individually or on a panel.

* Original contributions of major significance in your field.

* Authorship of scholarly articles in professional journals or major media.

* Artistic exhibitions or showcases where your work has been displayed.

* Leading or critical role in distinguished organizations.

* High salary or other significantly high remuneration compared to others in the field.

* Commercial successes in the performing arts.

The EB-2 NIW is for professionals holding advanced degrees or individuals with exceptional ability who seek a waiver of the job offer requirement in the national interest. Applicants can self-petition without employer sponsorship.

Qualifications:

Applicants must first meet the EB-2 criteria:

Advanced Degree: A degree above a bachelor's (or a bachelor's plus five years of progressive experience).

Exceptional Ability: A degree of expertise significantly above that ordinarily encountered in the sciences, arts, or business.

For the NIW, applicants must also demonstrate:

1) The proposed endeavor has substantial merit and national importance.

2) You are well-positioned to advance the proposed endeavor.

3) On balance, it would be beneficial to the U.S. to waive the job offer and labor certification requirements.
