Benefits of the EB-1A Green Card Program

The EB-1A (Employment-Based First Preference – Extraordinary Ability) immigrant visa program is an excellent option for highly accomplished individuals who want to live and work in the United States. Here are some key reasons why this category is so beneficial:

1. A Path to U.S. Permanent Residency

You can apply for permanent residency if your EB-1A self-petition (I-140) is approved. Concurrent filing of an I-140 & I-485 is allowed if visa numbers are immediately available and you are in the US on a non-immigrant visa, such as F1. Once your I-485 is approved, you will have the right to live, work, and stay in the U.S. indefinitely. Additionally, you can apply for U.S. citizenship once you reach the 5-year mark as a green card holder.

2. You Can Apply on Your Own

Unlike most employment-based green cards, you don’t need a job offer or a company to sponsor you. With the EB-1A, you are in control and can submit the petition yourself as both the Petitioner and the Beneficiary.

3. Your Family Can Come Too

Your spouse and children under 21 can join you and apply for green cards. The process is streamlined, and there’s no need for separate family petitions like I-130s, saving a lot of time and effort. Your children can attend public schools for free, and your spouse can pursue his/her career goals or other opportunities.

4. Faster Approval Times

The EB-1A is part of the first preference category, which often has shorter waiting times compared to other employment-based visas. In many cases, visas are available right away, making it one of the fastest ways to get a green card. Similarly, NIW (National Interest Waiver) applicants enjoy shorter waiting times compared to other categories.

5. No Need for Labor Certification (PERM)

The EB-1A process skips the labor certification (PERM) requirement. This step can be very time-consuming and involves proving that no qualified U.S. workers are available. By avoiding this extra step, you save a lot of time.

6. Live and Work Anywhere (No Geographical Restrictions)

With a green card, you have the freedom to live and work anywhere in the United States.

If you qualify for an EB-1A visa, this can be the fastest way to obtain a green card. If you can prove at least 3 out of the 10 criteria set by USCIS through objective evidence (generally, 4 recommended to be on the safe side), it’s worth considering this route.

Even if you don’t meet the criteria right now, it is better to consult with an experienced attorney to learn how you can strengthen your case and meet the requirements in the future. If you’re looking for a way to immigrate using your exceptional abilities in your field, don’t hesitate to reach out.
